These Terms of Service (“Terms”) cover your use of the Typh website and store at shoptyph.com (the “Services”). “Typh,” “we,” “us,” and “our” mean the Typh brand operated at shoptyph.com.

By browsing or ordering through the Services, you agree to these Terms. If you do not agree, do not use the Services. Our store runs on Shopify Inc.’s e-commerce platform.

1. Changes

We may update these Terms by posting a new version here and changing the “Last Updated” date. Updates apply prospectively only—to use and orders after posting. They do not rewrite Terms for orders you already placed, unless law requires otherwise or you agree to a change we notify you about.

2. Eligibility and use

You must be at least 18, or use the Services with a parent or guardian who agrees to these Terms.

You may use the Services for personal shopping and learning about Typh. Do not scrape, reverse engineer, disrupt, send malware, or use the site unlawfully. We may refuse service or cancel orders if we reasonably believe you violated these Terms or the law.

3. Product information

We aim for accurate details, pricing, and availability, but errors can occur. We may correct information and cancel affected orders when needed.

We try to show colors accurately. Displays differ, so we cannot guarantee your screen matches the product exactly.

4. Intellectual property

Site content (text, photos, logos, design) belongs to Typh or our licensors. You may view it for personal use. Do not copy, distribute, or make derivative works without written permission.

5. Orders, pricing, and commercial resale

A product listing is not a binding offer. We may accept or decline all or part of an order, even after confirmation.

If we cancel an order (or part of one) after charging you, we will issue a prompt refund of the charged amount for the canceled item(s) to your original payment method.

Provide accurate checkout information.

Commercial resale. Do not buy primarily for unauthorized commercial resale or wholesale without our written consent. This does not stop you from later selling or gifting pieces you bought for yourself in the ordinary personal way.

6. Prices and availability

Prices and stock may change. We may limit quantities or discontinue products, and we need not honor a listing made in error.

8. Events beyond our control

We are not responsible for delays from events outside our reasonable control (for example natural disasters, epidemics, labor disputes, war, government actions, outages, or carrier problems).

9. Disclaimers

To the fullest extent allowed by law, the Services are “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise uninterrupted or error-free access. Where disclaimers are limited by law, this section applies only as far as allowed.

10. Limitation of liability

To the fullest extent allowed by law, Typh and anyone helping operate the Services are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill, from your use of the Services.

Except for the carve-outs below, our total liability for a claim under these Terms or the Services will not exceed the greater of (a) what you paid us for the product(s) at issue in the prior twelve (12) months, or (b) US $100.

These limits do not apply to our fraud or fraudulent misrepresentation; our gross negligence or willful misconduct; death or personal injury caused by our negligence where that cannot be limited; non-waivable statutory consumer rights; or any liability that cannot legally be limited or excluded.

11. Indemnification

You will indemnify Typh against claims and reasonable costs (including reasonable attorneys’ fees) to the extent caused by: (a) your unlawful misuse of the Services; (b) your breach of these Terms; or (c) your violation of another person’s rights.

12. Governing law and disputes

These Terms are governed by California law, except where mandatory consumer rules where you live cannot be waived.

Except where prohibited, disputes not resolved informally will be heard in state or federal courts in California, and you consent to that venue. Eligible small-claims actions may still be brought where you live if that court has jurisdiction.

13. Third-party links

Linked third-party sites are outside our control. We are not responsible for their content or policies.

14. General

If one part of these Terms is unenforceable, the rest still applies. Not enforcing a provision is not a waiver. We may suspend access if you breach these Terms. IP, disclaimer, liability, and indemnity sections survive termination.

These Terms plus our Privacy Policy and Shipping & Returns policy are the full agreement between you and Typh about the Services.
